SPECIAL DISABILITY TRUSTS

If you are a parent or immediate family member of a person with a severe intellectual disability and want to put money away for the current and future accommodation and support needs of a severely disabled child, you might consider setting up a Special Disability Trust.

A Special Disability Trust is a trust established solely for the future care and accommodation of a person with a severe disability.

Special Disability Trusts are quite complex. Before you can create a Special Disability Trust your lawyer will need to be satisfied that:

  1. The beneficiary suffers from a severe intellectual disability
  2. The Trust complies with certain conditions, and
  3. The person contributing money to the Trust complies with certain conditions
